How can I recover lost wages in a pedestrian accident case?
In California, an injured pedestrian may be able to recover lost wages from the at-fault driver from a pedestrian accident lawsuit. The pedestrian must be able to prove that the accident was caused by the negligence of another driver, and that their injury caused them to lose wages. The pedestrian can bring a claim for medical bills and lost wages at the same time and the court will generally award damages for both. To be able to recover lost wages, though, the pedestrian must document their earnings and the amount of time they had to take off work as a result of their injury. They should have records such as paystubs, invoices, or time sheets that show the amount of wages they lost due to the accident. In addition, the pedestrian will need to prove that the accident was not their fault and that the other driver was negligent in some way. Evidence may include a police report, eyewitness accounts, medical records, and photos or videos of the scene. Witnesses should also be identified who can testify that the other driver was at fault. The pedestrian’s lawyer can then evaluate the case and calculate the total amount of lost wages and other damages. After a settlement is reached in the pedestrian accident case, the injured pedestrian should receive compensation for their lost wages.
