What are the restrictions regarding the labeling of drugs?
In Nebraska, it is illegal to label a drug in a false or misleading way. According to the Nebraska Pharmaceutical Law, the label must contain the name and address of the manufacturer, packer, or distributor, the name of the drug, description of the drug, and certain instructions regarding the use of the drug. The label must also include adequate directions for use as appropriate and the statement "Caution: Federal law restricts this drug to use by or on the order of a licensed veterinarian." Labels must also provide a list of ingredients, including active ingredients, inactive ingredients, and a statement of the potential risks of using the drug. Additionally, the warning statement “Keep out of reach of children” must appear on the label. The Nebraska Pharmaceutical Law also requires that drugs that contain ephedrine, ma huang (a type of herb), or substances containing ephedrine be labeled clearly and prominently with the following statement: "This product contains a chemical known to the State of Nebraska to cause cancer." Finally, labels of drugs that contain pseudoephedrine must include clear and prominent statements regarding the potential for abuse and addiction. The label must also instruct consumers to store the drug in a location that is not accessible to minors.
