How does the court decide who is responsible for a plane crash?

In Oregon, courts use a legal concept called “comparative negligence” when deciding who is responsible for a plane crash. This means that the court looks at the behavior of everybody involved in the accident to decide who is to blame. The court compares each person’s behavior to the standard of what a reasonable person would do in the same situation. If a person’s behavior falls short of the standard of care, then they can be held responsible for the plane crash. The court also looks at any laws or regulations that were broken during the crash. If it is determined that a law or regulation was broken, then whoever broke that law could be held responsible for the crash. Additionally, the court could find a party liable if they knew or should have known that their actions could cause harm to others. Finally, if a party is found to be grossly negligent or reckless, then they may be held liable for the crash. Gross negligence or recklessness is when someone acts in an extreme way that is far beyond what a reasonable person would do in the same situation. Ultimately, the court will look at all of the evidence to determine what caused the plane crash and who is responsible for it. The court will weigh all of the factors and make a decision based on all of the evidence presented.
