What kind of damages can be recovered in a professional negligence claim?
In Florida, when there is a claim of professional negligence, the person who is claiming they have been wronged can recover damages. Damages are intended to compensate the plaintiff (the one making the claim) for their losses. The types of damages that may be recovered in a professional negligence claim are economic and non-economic. Economic damages refer to those losses that have an actual dollar value, such as medical bills, lost wages, and damage to property. Non-economic damages refer to those losses that do not have a dollar value, such as physical pain and suffering, mental anguish, or loss of companionship. In addition to these damages, the plaintiff may also be able to recover exemplary damages, also known as punitive damages. These damages are meant to punish the defendant (the one being sued) for their negligence. Finally, the plaintiff may be able to recover attorney fees if it can be shown that the defendant’s negligence was intentional or malicious. In Florida, it is important to be aware of the statute of limitations when considering a professional negligence claim. This is a law which states that a claim must be filed within a certain amount of time to be considered valid. If the claim is not filed within the allotted time period, the right to receive compensation for losses may be lost.
