What is the standard of care in professional liability law?
In Arizona, professional liability law is the set of laws that holds a professional accountable for performing services that do not meet a certain standard of care. The standard of care for a professional is based on the expectation of what a reasonable professional in the same field would do under the same circumstances. This is known as the reasonable person standard. In order to determine if a professional in Arizona has breached their duty to provide a standard of care, the court must evaluate how the professional performed their duties. This evaluation includes whether the professional acted with the competence and skill that a reasonable person in the profession would demonstrate. Additionally, the court must consider what the professional did or did not do, any special circumstances that may have influenced the professional’s actions, and the applicable law that applies to the professional’s actions. In some cases, a professional may be able to demonstrate that they acted in accordance with their professional’s standard of care, even if the outcome was not successful. In other cases, a professional may be liable for breaching their duty of care even if they acted in accordance with the professional’s standard of care at the time. In all cases, the court must evaluate how the professional conducted their services and the reasonable person standard of care as it applies to the specific situation.
