What is the difference between professional negligence and ordinary negligence?
The difference between professional negligence and ordinary negligence is that professional negligence involves an individual or company providing services that do not meet the professional standards within their field. Professional negligence occurs when a professional fails to meet the standard of care required in their profession, and results in a breach of duty. Ordinary negligence is similar to professional negligence in that it also involves a breach of a duty of care. However, it is not limited to professionals and can involve any person who fails to act with reasonable care. For instance, if you fail to look both ways before crossing the street and you are hit by an oncoming car, you may be liable for ordinary negligence. Professional liability law in Georgia requires that professionals who fail to meet the reasonable standard of care in their profession can be held accountable. Professionals can also be held liable for the wrongful actions of their employees or agents. Professionals must take care to ensure that their employees and agents are properly trained and are following the necessary standards of care. If they do not, then they can be found liable for the negligent actions of those employees and agents.
