What is the difference between negligent and intentional acts of professional negligence?

Negligent and intentional acts of professional negligence are both forms of professional liability law and occur when a professional fails to provide services as promised. The primary difference between the two is the level of intent the professional had when they committed the act. Negligent acts of professional negligence occur when the professional did not have the intention to cause harm to someone or to breach their contract. This is usually a mistake or a lack of care when providing services. Intentional acts of professional negligence are much more serious and occur when the professional intended to cause harm or breach the contract. These acts can be described as malicious or intentional and can range from fraud to intentionally providing incorrect services or advice. In Montana, professionals are responsible for complying with professional liability law. If a professional is found to have committed an act of professional negligence, they can be held liable for any damages, losses or expenses incurred as a result of their actions. In extreme cases, the professional may be subject to disciplinary action or even license suspension or revocation.
