What is the legal definition of a prescription drug?

In North Carolina, a prescription drug is defined as a drug that requires a physician’s prescription to purchase and use. This includes both over-the-counter and prescription medications, provided that they are prescribed for a specific person for a specific medical reason. Generally, these medications are offered as a public health service and the prescribing physician must meet certain qualifications and adhere to a standard of care when prescribing controlled drugs. Prescription drugs are regulated by the Drug Enforcement Administration (DEA) in order to ensure that they are used safely and judiciously. They are categorized into “schedules” based on the potential for abuse and addiction, and the strength of the chemical substance. Drug schedules are created based on factors such as the potential for abuse, accepted medical uses and the safety of the user. Prescription drugs are dispensed by pharmacists who are certified and licensed by the North Carolina Board of Pharmacy. All distribution and sales of controlled substances must be in accordance with state and federal laws. Pharmacists must also ensure that the patient is aware of the proper use and administration of the medication, and they are responsible for advising the patient of any potential side effects.
