What are the penalties for violating HIPAA?

In North Dakota, HIPAA violations are seen as serious offenses that come with hefty penalties. Violators may be subject to both civil and criminal penalties. Civil penalties for a HIPAA violation may include a fine of up to $50,000 per violation or a maximum of $1.5 million in a single year. If the violation is seen as intentional or due to willful neglect, the penalty may be as high as $250,000 per violation or a maximum of $2.5 million in a single year. Criminal penalties may be imposed if the individual or entity knowingly or intentionally used protected health information in a manner that is illegal. An individual could be subject to up to $50,000 in fines and/or up to one year in prison, while an entity can face up to $50,000 in fines and/or up to five years in prison. In a case of extreme negligence, a penalty of up to $250,000 and/or a prison sentence of up to ten years could be imposed. In all cases, a HIPAA violation may also have serious implications for a person’s career. For example, if the individual was employed as a healthcare provider, then they may face loss of license, suspension, or a fine from the relevant licensing board. In addition, a HIPAA violation could have an adverse effect on potential future employment opportunities. A record of a HIPAA violation could result in being denied a job or other professional opportunities.
