Data breach notification plays an important role when it comes to privacy law compliance. In Florida, the state’s Deceptive and Unfair Trade Practices Act (FDUTPA) serves as the foundation for privacy law compliance. This law requires any company that collects or stores personal information to notify the affected individuals when a data breach occurs. This not only helps keep individuals informed, it also acts as a deterrent for companies that try to hide a data breach. In addition to the FDUTPA, Florida also enforces a few other laws related to data breach notification. The Florida Information Protection Act of 2014 requires any business that collects personal information on a Florida resident to promptly notify them if there is a breach of security. The act also requires any business, government agency, or other entity that maintains personal information to notify the Office of the Attorney General and the Department of Legal Affairs if a breach occurs. Lastly, organizations must also comply with the new GDPR (General Data Protection Regulation) that went into effect in May 2018. The GDPR requires organizations to not only notify affected individuals of a data breach, but to also report the incident within 72 hours of becoming aware of it. Overall, data breach notification plays an essential role in privacy law compliance. It not only helps keep individuals aware of any potential risks, but it also serves as a deterrent for companies who try to hide data breaches.
