What is the statute of limitations for product liability claims?
In California, the statute of limitations for product liability claims is generally two years from the date of the injury or damage caused by the product. However, in cases involving a foreign manufactured product, a plaintiff has three years to file a lawsuit. Additionally, if the product was not reasonably discoverable until after the two-year time frame, then the statute of limitations is extended to one year from the date of discovery. The statute of limitations is important since it places a time limit on when a lawsuit must be filed. Once the statute of limitations has expired, the plaintiff may no longer be able to file a lawsuit. However, in some cases such as with minors or those with a mental illness, the statute of limitations may be tolled or delayed. In order to determine the applicable statute of limitations, it is important to contact an experienced products liability lawyer who can examine the specifics of each case and provide guidance as to how to proceed. Furthermore, the sooner a lawsuit is filed in relation to the incident, the better chance the plaintiff has at recovering damages.
