What is the statute of limitations for product liability claims?
In Washington, the statute of limitations for a product liability claim is three years. This means that an individual must bring a product liability claim within three years of the date of the product’s purchase or if the injury was caused by a manufacturer’s defect, within three years of the date the injury occurred. The three-year statute of limitations applies to all product liability claims, including breach of warranty claims and claims of negligence, strict liability, breach of contract, and misrepresentation. If a company denies liability for a product, this time period starts when the company denies liability. If a claim is not brought within this three-year time period, the person bringing the claim may be barred from pursuing it in court. This can result in an individual being unable to recover damages for an injury caused by a defective product. To avoid this, it is important to file a product liability claim as soon as possible. Doing this gives an individual the best chance of being able to recover any damages caused by a defective product. It also ensures that the company responsible for the product can be held accountable for any injuries caused.
