How is the price of a defective product determined?

The price of a defective product is determined by the problem with the product itself. In North Carolina, products liability law holds manufacturers, distributors, and sellers of goods responsible for damages caused by a defective product. It is the responsibility of the person or persons responsible to compensate the consumer for the cost of damages related to the product’s defect. The amount of damages that can be awarded to the consumer is calculated by considering the total purchase price of the item or the price that the consumer could have received for the item had it been without defect. Typically, damages are calculated as the difference between what the consumer paid for the item and the value of the item without the defect. In addition to compensating for out-of-pocket expenses such as the cost of repair or replacement, a consumer may be compensated for any personal injury that occurred as a result of a defective product. In some scenarios, a consumer may be allowed to recover additional damages, such as legal fees or damages related to emotional distress caused by the incident. When determining damages, courts must consider the facts of the situation and the severity of the defect. Depending on the circumstances, the court may award punitive damages in addition to the costs previously mentioned, as a way to punish bad-acting companies. Ultimately, the court determines the amount of damages that are to be awarded to the consumer depending on the facts presented.
