What type of damages can be recovered from a product liability lawsuit?

In Maryland, a person injured by a defective product may be able to recover damages from a product liability lawsuit. Damages can include both economic damages and non-economic damages. Economic damages may include medical bills, lost wages, and the cost of replacing or repairing the defective item. Medical bills may include reimbursement for the cost of doctor visits, surgeries, hospital stays, medications and other medical expenses. Lost wages may include money lost from missed work due to the injury or disability caused by the defective item. Non-economic damages, such as pain and suffering, emotional distress, disfigurement, or disability, may also be recovered in a product liability lawsuit. These damages are often difficult to quantify and may require expert testimony in order to be awarded. In addition, a successful plaintiff may be entitled to receive punitive damages, which are intended to punish the defendant for particularly egregious behavior. These damages are rarely awarded and are subject to a heightened burden of proof. Finally, in some cases, a court may award the cost of the lawsuit (including attorneys’ fees) to the winning party. This depends on the type of lawsuit and the jurisdiction where the court is located.
