What is the difference between a manufacturer’s warranty and product liability law?
Manufacturer’s warranties and product liability law are two different legal concepts. On the other hand, product liability law is a legal concept that holds a manufacturer, supplier, or retailer responsible for any harm caused by a defective product. In Louisiana, the state’s laws allow a person injured by a product to pursue damages from the product’s manufacturer or seller. These damages may include medical bills, lost wages, pain and suffering, and other related expenses if the product is found to be defective. Manufacturer’s warranties are designed to protect consumers from economic loss due to defects in the product, while product liability law is designed to hold the manufacturer or seller responsible for any harm the defective product causes. Product liability cases are usually based on the concept of strict liability, meaning that the manufacturer can be held liable for any harm caused by its product, even if the manufacturer did not act negligently.
