What is a “manufacturing defect”?

A manufacturing defect is a type of product liability case in South Carolina. It occurs when a product has a defect due to an error that occurred during its manufacture. In other words, the product has a flaw that was caused by the manufacturer or by an employee of the manufacturer. Manufacturing defects are often the result of negligence on the part of the manufacturer. This means that the manufacturer failed to use reasonable care in the production and/or design of a product. A defect may also occur from a failure to properly inspect a product before it is sold to a consumer. Examples of manufacturing defects include a car part that has a structural flaw due to incorrect installation of the part, or a drug that is produced with an improper dosage. In contrast to a design defect, which is when the design of the product is inherently flawed, a manufacturing defect is a defect that occurs during the production process. In South Carolina, if a product has a manufacturing defect that causes an injury or damages, the injured person may be able to file a products liability lawsuit against the manufacturer. The manufacturer may be liable for the injuries or damages caused by the defect, even if the manufacturer wasn’t aware that the product was faulty. It is important to note, however, that not all flaws in a product are caused by a manufacturer’s negligence. In some cases, the flaw is a result of normal wear and tear, or misuse of the product.
