What are the differences between design defect and manufacturing defect claims?
Design defect and manufacturing defect claims are two different types of claims that arise out of products liability law in Washington State. A design defect claim occurs when a product has a design that makes it unreasonably dangerous. This means that the product is unsafe even if it was manufactured correctly. An example of a design defect would be a defective car part that causes the car to break down when driven. On the other hand, a manufacturing defect claim occurs when a product has been manufactured incorrectly, even if the design is safe. This means the product was made in a way that does not meet the specifications of the design, and causes a product to become dangerous. An example of a manufacturing defect would be a car part that was made with faulty materials, causing it to break down when driven. The main difference between a design defect and a manufacturing defect claim is that a design defect claim applies to any product that is made according to the design, but is still unsafe, while manufacturing defect claims apply only to products that have been made incorrectly. Generally, a person injured by a product must prove that their injury was caused by the defect in order to be successful in a products liability lawsuit.
