What types of legal documents are required to bring a product liability claim?

In order to bring a product liability claim in Oregon, several documents may be required. Depending upon the type of claim being made, supporting evidence may be required such as a medical report, expert testimony, evidence of the product’s design or manufacturing defect, a signed purchase contract or other documents. In a product liability claim, the plaintiff (the person bringing the claim) must prove that the product in question was defective or dangerous and that this defect caused their injury. To this end, a plaintiff must prove that the product was defective when it left the manufacturer or seller, and that the defect directly caused their injury. They can do this by providing evidence such as witness testimonies, reports prepared by expert witnesses, product testing and design reports, photographs or videos showing how the product was being used and details of the product’s design or manufacture. Other documents that may be needed to bring a product liability claim include a copy of the purchase contract (which proves ownership of the product) and bills or other evidence of the cost of medical care or lost wages resulting from the injury. The plaintiff must also provide proof of their injury and prove that the injury was caused by the product. This can be done with medical records detailing the injury, doctor’s notes outlining how the injury was caused, photos of the injury and any other document that might connect the defect to the injury.
