What is the “risk-benefit test”?
The “risk-benefit test” is a legal principle that applies to products liability law in Florida. This test helps decide if a product is unreasonably dangerous or safe to use. In Florida, the risk-benefit test is used when the consumer thinks a product is unreasonably dangerous or defective. Under this test, a product is considered to be unreasonably dangerous if the risks of using the product outweigh the benefits. The product must either have a design or manufacturing defects, or inadequate warnings or instruction for the user. The “risk” here is the danger posed to the consumer from using the product and the “benefit” refers to the usefulness of the product. To decide if the risks of using a product outweigh the benefit, a court will look at many factors, including the availability of alternative products, the nature of the product’s use, the gravity of the risk, and the social utility of the product. The more serious the risk or the greater the potential danger, the less likely the product is to be deemed as not unreasonably dangerous. The risk-benefit test is important because it helps the courts decide if a product is unreasonably dangerous or safe to use. When a consumer believes they have been injured by a product, they may be able to get compensation if the product is found to be unreasonably dangerous under the risk-benefit test.
