What is “strict liability”?

Strict liability is a legal principle that holds a person or entity responsible for the damages they cause regardless of fault or negligence. This type of liability is often applied in products liability law. In California, the rule of strict liability applies when a person or business is involved in the distribution, marketing, or sale of a product. Under this law, a person or entity who is involved in a product’s distribution is automatically held responsible for any damages the product causes. This means a person or business does not have to have been negligent or careless in order to be held responsible for the damage. A person or entity is only required to prove that they were involved in the chain of distribution of the product in order to be held liable. Additionally, a person or business does not need to show that the product was defectively designed or manufactured in order to be held liable. This type of liability puts the onus on the producer of the product to ensure the product is safe and free of defects, as they may be held liable for any damages caused even if they had no knowledge of the defect. Strict liability is an important part of products liability law and serves to ensure that companies are held accountable for the safety of their products and consumers are protected from dangerous products.
