What is a “market withdrawal”?

A market withdrawal is a legal term used in the context of products liability law in California. It refers to a situation where a manufacturer or a seller decides to take a product out of the market, voluntarily and without being ordered to do so by a court, as a result of a potential danger the product poses to users or consumers. A market withdrawal is typically done in order to protect the public from any potential harm the product may cause. It is also done in order to protect the company from further legal action. When a market withdrawal is made, the company is able to recoup some of the product costs by selling the recalled product in bulk to a business or distributor which will then dispose of the product. The manufacturer or seller may also be liable for the cost of repairing the product or reimbursing consumers who have purchased the product. In some cases, the manufacturer or seller may be legally required to compensate any individuals who have been injured as a result of the product.
