What is a “market withdrawal”?
In North Carolina, a “market withdrawal” is a type of product liability law. It applies when a product is recalled due to a defect, malfunction, or safety hazard. A market withdrawal occurs when the manufacturer takes back the product from its customers. This typically includes refunding customer money, replacing the product, or providing a repair service. Market withdrawals are voluntary acts taken by the manufacturer to protect its customers and the public from the risks associated with a defective or hazardous product. It allows the manufacturer to remove the product from the market without facing the legal and financial consequences of a potential product liability suit. A market withdrawal also serves to protect the reputation of the manufacturer and its products. By offering a full refund or replacement, the manufacturer is signaling that it is taking responsibility for the flaw in its product, and will proactively work to fix the problem. At the same time, a market withdrawal may not protect a manufacturer from product liability in certain cases.
