What is a “negligence claim”?
A negligence claim is a type of claim used in products liability law in South Carolina. It is when a plaintiff (the injured person) claims that the defendant (producer, seller, or other party involved) was negligent in the sale or manufacture of a product that caused the plaintiff’s injury. In order to win a negligence claim, the plaintiff must prove that the defendant breached an established duty of care. This means that the defendant was careless or did not take the steps necessary to protect the consumer from foreseeable risks. The plaintiff must also demonstrate that their injury was caused by the defendant’s negligence and that they suffered damages due to the defendant’s carelessness. In South Carolina, negligence claims in products liability law often arise when a person is injured by a defective product. A court must determine if the defendant was responsible for the defect and if they should have taken reasonable steps to prevent it. If the defendant is found negligent and the plaintiff suffered damages due to their negligence, the court may then award the plaintiff damages. It is important to note that each state has its own specific laws regarding negligence claims in products liability law. In South Carolina, a plaintiff must demonstrate that the defendant had a duty of care to the plaintiff, breached that duty, and caused the plaintiff’s injury in order to successfully make a negligence claim.
