What is adverse possession?

Adverse possession is a legal doctrine that allows someone to gain title to land that someone else owns. This doctrine has been used in Florida since the early 19th century and has been used to resolve land disputes. Adverse possession in Florida requires a person to take possession of the property in question, and to use it in an open and notorious manner, for a period of 7 years or more. In addition, the person claiming the property must prove that they have paid the taxes on the property and made improvements to the land during the time period in question. If the property owner fails to take action to reclaim their property within the 7 year period, then the person claiming title to the property may be able to gain legal title to the property. Adverse possession is an important legal doctrine that is useful in resolving disputes over land and property in Florida.
