What is partition of property?
Partition of property is a legal process in Washington where a piece of land, building, or other property is divided into two or more parts in order to share it between two or more individuals or legal entities. When a partition occurs, the court must make sure that the property is split in a fair and equitable manner. This process is most often used when two or more people own a single piece of property together and wish to divide it, usually because they are no longer able to work together or agree on the use of the property. The partitioning process can be completed through a partition lawsuit or voluntary agreement between the property owners. In a partition lawsuit, a court will first decide whether the property can be divided into shares that are equal in value or whether it needs to be sold and the proceeds divided. Once this determination has been made, the court will divide the property into shares, assigning a value to each share and awarding the shares to each owner. If a voluntary agreement is reached between the owners, the property can be divided according to the agreement, provided it is fair and equitable.
