How can I appeal a property tax assessment?
If you believe the amount of your property tax assessment in West Virginia is incorrect, you have the right to appeal it. To appeal your assessment, you must first contact your local county assessor’s office and provide documentation to support your claim. Examples of supporting documentation may include purchase price, recent appraisals, or other documents that support the value of the property. After submitting your documentation to the assessor’s office, you will need to attend a meeting with the assessor to discuss your appeal. At the meeting, you and the assessor will discuss the assessment and how it was determined. The assessor may decide to adjust the assessment or may provide an explanation as to why the assessment is accurate. If you disagree with the assessor’s decision after the meeting, you may file a formal appeal with the West Virginia State Tax Department. You must include in the appeal the documents you previously submitted to the assessor’s office along with a written statement that explains why the assessment is incorrect. The Tax Department will review the documents and conduct a hearing or issue a decision. If you still disagree with the assessment after filing a formal appeal with the Tax Department, you may file a civil suit with the appropriate circuit court. In the suit, you must include the assessment and all of the documents you previously submitted to support your appeal. No matter how you decide to appeal your assessment, be sure to keep detailed records and notes of all correspondence you have with the assessor’s office and the Tax Department.
