What is a patent?

A patent is a type of legal protection given to an inventor from the government for a particular invention. It is a form of intellectual property that gives inventors the exclusive right to make, use and sell the invention, and to prevent others from doing so without permission. In California, a patent is granted by the United States Patent and Trademark Office (USPTO) to an inventor who has created something that is new, useful, and not obvious. In order to get a patent in California, the inventor must file a patent application with the USPTO and prove that their invention is novel and non-obvious. The application must also include a detailed description of the invention, drawings, and claims that describe the invention’s unique features and how they are used. Once the patent is granted, it gives the inventor exclusive rights to the invention for 20 years from the date of filing. Patents can provide inventors with significant legal protection and help to increase their potential profits from the invention. They can also be used to prevent competitors from copying the invention, to stop the sale of counterfeit versions, and to protect the invention from unauthorized use. Additionally, patents can be used to sell the invention to a company or manufacturer, or to license the invention to others for a fee.
