How do I register a trademark?

In order to register a trademark in Utah, you must first complete a trademark application. This application must be sent to the United States Patent and Trademark Office (USPTO). The application is available online and must be filled out properly and include all relevant documents. Once the application is submitted, the USPTO performs a trademark search to determine if your trademark is already in use. If the search is favorable, the USPTO will then send you a Notice of Publication for the proposed trademark. This notice provides thirty (30) days to respond to challenges from any other businesses or individuals who might have a claim to the trademark. If there are no challenges, the USPTO will then proceed to register the trademark. Once the trademark is registered, the owner is granted exclusive rights to the trademark for a period of ten (10) years. During this time, no other business or individual may use the trademark or a mark which is substantially similar to it. After ten (10) years, the trademark must be renewed or it will become invalid.
