What is a patent reexamination?
Patent reexamination is a process in North Carolina whereby the validity of a patent may be challenged and/or re-evaluated. It is a legal process administered by the United States Patent and Trademark Office (USPTO). The purpose of a patent reexamination is to determine whether a patent is valid as granted or should be modified or revoked. The process is initiated by a request from a person other than the patent owner, which may be a third party, such as a competitor, or a government agency. The patent reexamination process is similar to the patent application process in that an examiner reviews the patent to determine whether all the legal requirements are met and whether the patent covers new and inventive subject matter. The examiner also reviews the prior art to determine whether the patent is sufficiently novel and nonobvious in view of the prior art. If there is any doubt as to whether the patent is valid, the examiner may request further information and/or modify the patent. If the examiner finds that the patent is invalid, the patent may be revoked, amended, or a new claim may be added to the patent. Once a patent is reexamined and the decision is made on the validity of the patent, the decision is appealable. The decision may be appealed to the United States Court of Appeals for the Federal Circuit or the United States District Court.
