What is a patent infringement lawsuit?

A patent infringement lawsuit occurs when a patent holder believes that someone has stolen their intellectual property. The patent holder must prove that they invented the product or process, and that the accused has used without authorization. Patent infringement lawsuits are usually heard in a civil court and the patent holder must show that the accused has copied the invention in some way. In California, a patent infringement lawsuit must also show that the accused had knowledge of the patent, and that the accused made a substantial effort to use or copy the patent without permission. The patent holder must also show that the product or process of the accused is substantially similar to that of the patent holder. If the patent holder is successful in their lawsuit, the judge can grant a variety of remedies, including damages, injunctions, and orders to pay legal fees. Depending on the circumstances, the judge may award the patent holder with a percentage of the profits made by the accused, or other forms of payment for their violation of the patent. Patent infringement lawsuits are an important part of protecting intellectual property, and are designed to encourage innovation and prevent theft of ideas. As such, patent infringement lawsuits can be very complex and are best handled with the help of an experienced patent attorney.
