What is a reissue patent?
A reissue patent is a type of patent available to inventors in Texas who have already been granted a patent. It is a form of legal protection that allows the holder to make corrections to the existing patent, such as correcting errors or expanding its scope. The purpose of the reissue patent is to restore the inventor’s rights that were previously limited due to mistakes made in the original patent. For example, if an inventor fails to accurately describe the invention in the patent, or if the patent covers less than the full scope of the invention, the inventor can obtain a reissue patent to make corrections. In order to obtain a reissue patent, the inventor must fill out a reissue application and submit it to the United States Patent and Trademark Office (USPTO) in Texas. The application must include a description of the invention, a discussion of the errors made in the patent, and a request for expansion of the invention’s scope. If the reissue patent application is approved, the inventor will be granted a reissue patent that restores their rights to the full scope of their invention. The reissue patent is distinct from the original patent, with a distinctive patent number, and the rights are the same as those granted in the original patent.
