What is a Statement of Use?

A Statement of Use is a document filed with the US Patent and Trademark Office (USPTO) that informs the USPTO of the completion of a trademark application. The Statement of Use must include the exact date when use of the trademark began and the type of goods or services that are sold with the trademark. In Washington state, the Statement of Use can be filed electronically or by mail. In either case, the Statement must be accompanied by a specimen of the trademark in use. The specimen should show how the trademark appears on the goods or services. In the event that the trademark is not yet in use, an applicant may file a Request for Extension of Time to File a Statement of Use. The applicant must include a specific reason for the request and provide a date when use of the trademark is expected to begin. Once the USPTO has received the Statement of Use, complete with accompanying specimen, the trademark is registered and the applicant is granted exclusive rights to its use. This means that the trademark may be enforced in court if it is being used without the applicant’s consent.
