What is a patent office action?

A patent office action is a document issued by a patent examiner as part of the process of granting a patent in the United States. The document is written in response to an application for a patent and typically outlines any changes that need to be made to the application in order for it to be granted. The patent office action is the first step of the patenting process and is used to inform the patent applicant of what needs to be done to make the application compliant with patent laws in the United States. In California, the patent office action is issued by the United States Patent and Trademark Office, commonly known as the USPTO. The patent office action can contain a number of different requests, depending on the application. It could include a request for more information in order to make the application more complete, or a request to make changes to the patent claims or drawings. It could also identify prior art that was not disclosed in the patent application, or suggest potential areas of patent invalidity that need to be addressed. The patent applicant must then respond to the patent office action within a specified time period, usually three months, in order for the patent application to be processed further. In California, the USPTO is the organization responsible for issuing patent office actions and processing patent applications. The USPTO has offices located in San Jose and Alexandria, Virginia and provides resources for applicants and attorneys to help them navigate the patenting process. The USPTO also offers a number of search tools and resources that can help applicants locate prior art that must be disclosed in the application.
