What is a patent assignment?
A patent assignment is a legal agreement between two parties, in which a patent owner transfers their rights to the patent to another party. This typically happens when a patent is sold or licensed to another party, allowing them to use the invention, produce, and/or sell the invention, and also file any related patent applications. In Alaska, the patent assignment must be in writing and be signed by both parties. The assignor must also provide a copy of the assignment to the U.S. Copyright Office and the Alaska Department of Commerce, Community & Economic Development. Additionally, the assignor must provide the assignee with a copy of the assignment, the U.S. Patent and Trademark Office’s assignment recordation form, and any applicable information about the related patent. By assigning a patent, the assignor is legally and financially responsible for the assignment agreement, including any infringement claims. Furthermore, the assignor must make sure that the assignee can defend the patent from any third party claims, and must also display ownership information, such as their name and address, on the patent and documents associated with it. It is important for any parties involved in a patent assignment to understand the different legal agreements and follow all of the necessary procedures.
