What is a reexamination certificate?
A reexamination certificate is a specific type of patent granted by the United States Patent and Trademark Office. This type of patent is issued when an invention is shown to meet the Patent Office standards in a second or additional examination. A reexamination certificate is issued when the applicant (inventor) requests an examination of a previously-filed application in Minnesota and the office finds the invention meets all the requirements for a patent. When a reexamination certificate is issued, it is valid for the same length of time as a regular patent. It could also be renewed, or extended, as long as the original invention remains valid. In Minnesota, the certificate is generally issued with amendments, or changes, to the previous application that must be made in order for the invention to meet the criteria of a patent. Reexamination certificates are important for inventors in Minnesota, as they protect the inventors’ patent rights and allow them to prove that their invention was in fact innovative and unique. The reexamination process helps to ensure that any issued patent is valid and that it meets the criteria set forth by the Patent Office. As such, reexamination certificates are a valuable asset to inventors in Minnesota and the US as a whole.
