What is a reexamination certificate?

A reexamination certificate is a legal document issued by the United States Patent and Trademark Office (USPTO) that grants a patent holder the right to reexamine the claims of their patent. It may also be known as a “reexam certificate” or “reexam request”. A reexamination certificate allows a patent holder the opportunity to review the claims of their patent, and potentially make changes or amendments to those claims. This review is generally done so that the patent holder can make sure their patent is in compliance with the latest patent laws and regulations. A reexamination certificate can be requested by the patent holder or initiated by the USPTO. In New York, a reexamination certificate must be requested from the USPTO’s Central Reexamination Unit (CRU). Once the request is approved, the patent holder is then able to use the reexamination certificate to submit a reexamination request to the CRU. The USPTO will then consider the request and investigate the claims of the patent. The USPTO will then issue a reexamination certificate, which is a formal document stating that the patent holder may submit a reexamination request. This document will also contain the patent’s claims, a statement that any amendments to the claims are approved, and a statement that any new claims are also approved. A reexamination certificate is an important document for patent holders to obtain as it allows them to review the claims of their patent and ensure that the claims are in compliance with current patent laws and regulations. This document can ultimately save a patent holder from potential infringement lawsuits or other costly litigation.
