What is the difference between a provisional and a non-provisional patent application?

In North Dakota, patent law is the area of law that governs the protection of inventions and the right to exclude others from using or selling them. A patent application is a legal document that describes an invention and requests protection for it. This document is submitted to the United States Patent and Trademark Office (USPTO). There are two types of patent applications: provisional and non-provisional. A provisional patent application is a shorter, temporary version of a non-provisional patent application. It is less formal and doesn’t require as much detail as a non-provisional patent application. A provisional patent application provides the USPTO with enough information to determine whether a patent should be issued. It also gives the inventor a year to complete the non-provisional patent application without having to worry about the patent expiring. However, provisional patent applications are not reviewed by the USPTO and will not be issued a patent. Non-provisional patent applications are the complete and formal version of the patent application. They must include detailed descriptions of the invention, diagrams, and claims. Non-provisional patent applications are thoroughly reviewed by the USPTO and, if approved, will be issued a patent. In summary, a provisional patent application is a temporary, shorter version of a non-provisional patent application that is not reviewed by the USPTO and will not be issued a patent. A non-provisional patent application is the final version of the patent application that includes detailed descriptions of the invention and is reviewed by the USPTO and can be issued a patent if approved.
