What if someone else has a similar invention?
Patent law in North Carolina protects inventors who have developed new products or processes. While someone else may have a similar invention, the inventor with the patent has exclusive rights to make, use or sell the invention. If someone else has a similar invention, the inventor with the patent can take legal action against the other inventor if they are using the same invention without permission. The US Patent and Trademark Office (USPTO) examines applications for patents to ensure that the invention meets the criteria for a patent. The criteria includes that the invention must be new, useful, and non-obvious. An inventor that has gone through the process and been granted a patent has the exclusive rights to the invention. If someone else has created a similar invention, the inventor with the patent can take legal action against the other inventor. Copyright and trademark laws may also protect the inventor if the invention is an artistic or literary work. The other inventor may also be infringing on the patent if their invention does not meet the criteria set forth by the USPTO. Such criteria includes the invention must not be similar to any prior invention that had been in use or publicly known. In summary, if someone else has a similar invention, the inventor with the patent may take legal action against the other inventor. This is because the inventor with the patent has exclusive rights to the invention and the other inventor may be infringing on the patent if their invention does not meet the criteria set forth by the USPTO.
