What is a patent bar?

A patent bar is a professional exam that must be passed in order to practice patent law in Washington. The exam is designed to test an individual’s knowledge and understanding of patent law, such as U.S. patent statutes and government regulations, the U.S. Patent and Trademark Office (USPTO) guidelines, court opinions, and other legal precedents. Passing the patent bar allows an individual to represent inventors before the USPTO, as well as advise clients on intellectual property and patent-related matters. To be eligible to take the patent bar, an individual must have a four-year degree in a technical field, such as engineering, chemistry, computer science, or biology. Moreover, the individual must have either a degree in law or have at least two years of experience in a patent-related field, such as patent law, patent prosecution, or patent analysis. Once the individual has passed the exam, he or she will be formally authorized to practice patent law in Washington. Although passing the patent bar is not required to practice patent law in every state, it is a valuable asset in Washington, as it demonstrates to potential employers that an individual has the necessary credentials and experience to handle patent-related matters. It also demonstrates to clients that the individual is not only competent in the legal field, but is also familiar with the current patent-related issues that may affect their business.
