What is a boundary line dispute?

A boundary line dispute is a legal disagreement over the location of the boundary line between two adjacent properties, most commonly between two parcels of land. In California, boundary line disputes are addressed through civil lawsuits brought in the courts of the state. These disputes arise when one person believes that the boundary line between two properties should be located in one place, and another person believes it should be located in a different place. Boundary line disputes can arise for a variety of reasons, including when a person buys a piece of property without knowing the exact location of the boundary line, when a property owner surveys the land and finds a discrepancy between what was expected and what was found, or when a piece of land is used by two adjacent property owners in different ways over a period of time. Additionally, a judge may order the parties to use a surveyor, or a neutral third-party expert, or even to hire an expert witness to help with the case. In California, a boundary line dispute can be a complex and lengthy legal battle. It should be noted, however, that the judge is responsible for determining the legal boundary line and settling any disputes that may arise between the parties.
