What are the legal implications of in vitro gametogenesis?
In vitro gametogenesis (IVG) is a new reproductive technology that involves the creation of gametes (sperm and egg cells) in a lab setting. In Indiana, IVG is primarily regulated through the Indiana Parentage Act. This Act essentially states that individuals who use IVG to create offspring and do not use a sperm or egg donor are recognized as the legal parent(s) of that child. Conversely, if a sperm or egg donor is used, the donor has no legal rights or responsibilities towards the child. In addition, the legal rights and responsibilities of parents created through IVG must be agreed upon by both parents before the procedure is performed. While IVG is largely unregulated and legal implications are still developing, there are a few restrictions in place. For example, egg donors must be over the age of eighteen and must have received all necessary counseling and medical evaluations prior to donating their eggs. Furthermore, the eggs must be frozen and stored according to the American Society for Reproductive Medicine’s standards. Finally, any IVG procedure must be performed under the supervision of a licensed physician. Ultimately, as IVG technology develops, so too do the legal implications. In Indiana, IVG is primarily regulated by the Indiana Parentage Act which largely recognizes IVG parents as the legal parents to the resulting children. It is important to ensure that all minors involved in IVG procedures are legally represented, as the implications of becoming a parent through IVG technology could be life-altering.
