What rights do I have when buying a home?

When buying a home in Delaware, you have certain rights and responsibilities outlined by state law. As a buyer, you have the right to inspect the property, negotiate with the seller, and receive certain disclosures. The Delaware Home Buyer Protection Act grants you the right to receive a Property Condition Disclosure Statement, an Assessment Disclosure Statement, a Seller’s Disclosure of Real Estate Transfer Tax, and a Seller’s Disclosure of Lead-Based Paint and/or Lead-Based Paint Hazards. The disclosure statements must be completed and signed by the seller and delivered to the buyer prior to the closing. It is the buyer’s responsibility to verify ownership of the property and make sure there are no liens or other title issues. You also must obtain homeowners’ insurance to cover the home and make sure it is up to date. Additionally, you must make sure that all permits, licenses, and inspections have been completed and that taxes are current. While the purchase ultimately rests on the buyer’s discretion, a real estate lawyer can provide valuable guidance and help protect your rights throughout the process. They can help you review legal documents, negotiate contracts, and ensure that the sale is in compliance with local and federal laws.
