What are the pitfalls of foreclosure?
Foreclosure is the legal process by which a lender reclaims a property from a debtor who has defaulted on loan obligations. While it sounds like a straightforward process, it can become complicated and fraught with pitfalls. First, a borrower may be liable for any unpaid fees and taxes on the property, which can be a substantial amount. This is in addition to the loan balance they are still obligated to pay. Secondly, the derogatory information associated with a foreclosure can remain on a person’s credit report for up to 7 years, making it difficult to obtain new financing. This can make it difficult to purchase another home or obtain other forms of credit. Third, a foreclosure can be a lengthy process that can take anywhere from 6 months to a year to complete. During this time, the borrower may face eviction proceedings and be unable to stay in their home. Fourth, the lender may elect to pursue a deficiency judgment against the borrower for any amount they cannot recover from the sale of the property. This can be an additional debt for the borrower to pay and can have a negative impact on their credit score. Finally, a foreclosure can have very serious personal and financial repercussions. In California, it may even result in the loss of a person’s home and contribute to their inability to build equity in a new home. The best way to avoid these pitfalls is to stay current on mortgage payments and take steps to develop a repayment plan with the lender if a hardship arises.
