What is a quit claim deed?
A quit claim deed is a legal document that transfers ownership of a piece of property. It is commonly used in residential real estate law in Iowa. In a quit claim deed, the grantor (the person transferring the property) transfers whatever rights they may have in a certain property to the grantee (the person receiving the property). The transfer is not guaranteed and the grantee takes the property with whatever title the grantor has. That means that if another party has a claim to the same property, such as another legal owner, the grantor does not promise clear title (ownership) to the grantee. This type of deed is often used in family transfers or between close friends because the parties trust each other. It is important to note that a quit claim deed is not a warranty deed, which offers more protection to the grantee. In the state of Iowa, a quit claim deed must be notarized and recorded in the county where the property is located. This is one way to prove ownership of the property and protect the rights of both the grantor and the grantee.
