What is a landlord’s lien?

A landlord’s lien is a legal right that landlords in North Dakota have to secure their property when a tenant owes rent. If a tenant does not pay their rent or damages the property, then the landlord has the right to use any of the tenant’s property left on the premises as payment. When a landlord claims a lien, they can take the tenant’s property and sell it at a public auction to recover the money owed. The landlord may also file a court action and receive a judgment against the tenant. The judgment will allow the landlord to take further action and receive the money owed. Before a landlord can exercise their lien rights, they must serve the tenant with a written notice of their intent to claim a lien. This notice must include a description of what the landlord claims is owed, the amount of the debt, and when the landlord claims it became due. Once the landlord serves the notice, the tenant has a certain amount of time to pay the amount owed or challenge the lien. If the tenant does not take action in this time period, then the lien will become effective and the landlord can legally collect their property from the tenant’s premises. It is important for tenants to understand their rights and obligations under North Dakota residential real estate law. This includes their responsibilities when it comes to landlord’s liens and the rights of the landlord to secure their property when a tenant fails to pay rent or damage the premises.
