What is real estate litigation law?

Real estate litigation law refers to the legal proceedings involved when real estate matters are disputed in North Carolina. It includes everything from dealing with landlord-tenant disputes or contract issues related to the sale or purchase of real estate, to construction defects, boundary line disputes, and zoning issues. When a real estate dispute arises, the first step is for both parties to attempt to reach an amicable resolution outside of court. If an agreement can not be reached between the two parties, legal action must be taken and the dispute is resolved through a legal process known as litigation. In real estate litigation, the parties involved may include homeowners, landlords, tenants, builders, contractors, and real estate agents. Depending on the case, there may be several legal issues that need to be addressed. This could include issues related to fraud, breach of contract, negligence, or other topics related to real estate. The litigation process begins when one of the parties files a lawsuit in court. During the process, each side will present evidence to support their case. If no resolution is reached, a judge or jury will decide who is right and who is wrong and issue a verdict. Real estate litigation law is an important field of law because it protects the rights of parties involved in real estate disputes and ensures that justice is served. It is important to consult a qualified real estate attorney when dealing with any real estate dispute in North Carolina.
