What are the different types of real estate dispute damages?
Real estate disputes in California can often result in monetary damages, or payments to compensate one party for the harm that occurred during the dispute. There are several different types of damages that may be awarded in a real estate dispute. The most common type is known as compensatory damages, which are monetary payments to cover the financial losses suffered by one party due to the other’s breach of contract or other wrongful action. Compensatory damages are intended to make the affected party “whole” financially, by restoring them to the same financial position they would have been in, had the wrongful actions not occurred. Another type of damages, known as punitive damages, is sometimes awarded in cases where one party acted in a particularly willful or egregious manner. Punitive damages are intended to punish the wrongdoer and to deter them from engaging in similar behavior in the future. However, punitive damages are difficult to win, as courts in California generally award them only when the conduct of the party at fault is particularly egregious. Finally, nominal damages are payments of a relatively small amount of money, intended to recognize the harm suffered by one party, even if they did not suffer a substantial financial loss. Overall, when a real estate dispute arises, the court may award one or all of these different types of damages to the party who has suffered harm. The type of damages awarded will depend on the facts of the case and the wrongs which have been committed.
