What is a legal action for wrongful eviction in a real estate dispute?

Wrongful eviction is a legal action for someone who feels they have been wrongly evicted from a property they own or rent. In the state of North Carolina, a person can file a legal action for wrongful eviction if they believe that their eviction was wrongfully done. This action is generally filed in civil court. In order to bring a wrongful eviction case to court, a person must prove that their eviction was unjustified and that they did not cause any damage to the property during their tenancy. The burden of proof is on the individual to prove that the eviction was wrongful, and they must also be able to show that the landlord acted illegally or in a way that was unreasonable or unfair. For example, if a landlord evicts a tenant without first providing written notice and an opportunity to be heard, or if the landlord evicts the tenant without abiding by the terms of a tenancy agreement, the tenant may be able to prove wrongful eviction. The remedies for a wrongful eviction can include monetary damages, return of the security deposit, reinstatement of the tenant’s lease, reimbursement of moving costs, and other items of compensation. Depending on the case, the court may also order the landlord to pay reasonable attorney’s fees incurred by the tenant in pursuing the wrongful eviction case.
