What are the laws and regulations regarding product liability and warranties?

Product liability and warranty law in Florida are laws and regulations that protect consumers from defective or dangerous products. Product Liability is a legal responsibility that manufacturers, distributors, and sellers have to consumers for injuries or damages caused by defective products. This means even if a product was made and sold with good intentions, if it is used or misused by consumers and injures them, manufacturers, distributors, and sellers can still be liable. In Florida, there are two types of product liability claims that a consumer can file: Negligence and Strict Liability. Negligence is when a manufacturer is found to have acted carelessly or recklessly in making, distributing, or selling a product. Strict liability is when a manufacturer is held responsible for a defect regardless of its level of care. When it comes to warranties, Florida customers are also protected. A warranty is essentially a guarantee from a manufacturer that a product will be free of defects that impede its performance. Most states have two types of warranties; express warranties, which are written, and implied warranties, which are assumed. Express warranties are promises made by the manufacturer regarding how the product will perform, and how it will be fixed if it breaks. Implied warranties are guarantees that the product is as described and will do its job. In Florida, state law requires some products to have a warranty, even if the manufacturer does not provide one. The warranty is implied. Therefore, manufacturers should be aware that they have an obligation to provide consumers with that guarantee, regardless of what type of warranty is given.
