What is small claims court?

Small Claims Court is a legal system in Delaware that resolves disputes between two individuals or entities without the need for a full-scale trial. In Delaware, Small Claims Court is divided into two levels: the lower District Court and the higher Court of Common Pleas. In the lower District Court, individuals can bring claims of up to $15,000 against another individual or entity. In the higher Court of Common Pleas, individuals can bring claims of up to $50,000. The main purpose of Small Claims Court is to provide an inexpensive and speedy way to settle disputes, so the process generally does not involve lawyers and takes less time than a full-scale court trial. The process for filing a claim in Delaware’s Small Claims Court begins with submitting a complaint to the court. This complaint must include the amount of money being requested, a concise statement of the claim, the name of the defendant, and the date of the event that caused the claim. The court will then schedule a hearing and both parties involved are expected to appear. During the hearing, each side will present evidence and state their case before a judge, who will then make a ruling. Overall, Small Claims Court is an efficient and cost-effective way to settle disputes without having to endure a lengthy court trial. Although the process may seem intimidating, it can be beneficial to both parties if the case is successfully resolved.
